These Terms of Service govern your use of Symkura, operated by MakeByte (Germany). By using Symkura you agree to these terms.
1. The Service
Symkura is a symptom documentation tool designed to help people with chronic conditions track pain, mood, sleep, medications, and other health indicators. It is a documentation tool, not a medical device, and does not provide medical advice, diagnosis, or treatment.
2. No Medical Advice
Symkura does not replace professional medical advice. On-device insights (correlations, patterns) are statistical observations, not diagnoses. Always consult a qualified healthcare provider for medical decisions.
3. Your Data
Your health data is stored on your device and synced TLS-encrypted to our servers in Germany via your account. You can delete your account and all server data at any time in the app. Uninstalling the app removes local data; your cloud data remains until you delete your account. App lock: the optional PIN/biometric lock protects access on your device. If you forget the PIN, you can reset the lock on the lock screen with your account password and set it up again in Settings.
4. Free & Pro Plans
Symkura offers a free tier and a Pro upgrade. Pro features are available via in-app purchase through the Apple App Store or Google Play. Pro can be purchased as a monthly subscription, yearly subscription, or one-time lifetime purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. The lifetime option is a single, non-recurring payment.
Refunds are handled by Apple or Google according to their respective policies.
5. Acceptable Use
You agree not to misuse the service, attempt to gain unauthorized access to our systems, or use Symkura in any way that violates applicable law.
6. Intellectual Property
Symkura and its content are owned by MakeByte. You may not copy, modify, distribute, or reverse-engineer any part of the app without written permission.
7. Liability
We are liable without limitation for intent and gross negligence and for damages resulting from injury to life, body or health. In cases of slight negligence we are liable only for the breach of essential contractual obligations (obligations whose fulfilment is a prerequisite for the proper performance of the contract and on whose compliance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected. Symkura is a documentation tool; medical decisions are made together with your doctor.
8. Termination
You may stop using Symkura at any time by uninstalling the app. We may suspend or terminate accounts that violate these terms.
9. Changes to These Terms
We may update these terms from time to time. Continued use of Symkura after changes constitutes acceptance. We will notify you of material changes via the app.
10. Governing Law
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the state in which you habitually reside. No exclusive place of jurisdiction is agreed with consumers.
